AN ACT

To amend an Act creating a board of commissioners of Cook County, approved August 12, 1919 (Ga. L. 1919, p. 627), as amended, particularly by an Act approved March 28, 1986 (Ga. L. 1986, p. 5029), so as to provide for staggered terms of office for members of the board of commissioners; to provide for transition terms of office; to provide for related matters; to provide for the submission of this Act for preclearance; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
An Act creating a board of commissioners of Cook County, approved August 12, 1919 (Ga. L. 1919, p. 627), as amended, particularly by an Act approved March 28, 1986 (Ga. L. 1986, p. 5029), is amended by striking Section 2 and inserting in lieu thereof a new Section 2 to read as follows:
"SECTION 2.
(a) The members of the board of commissioners who were elected at the general election in November 2000 shall continue in office for the terms to which they were elected and until successors are elected and qualified as provided in this Act.
(b) The members of the board of commissioners of Cook County from Commissioner Districts 1 and 5 shall be elected at the state-wide general election in 2004. Such members shall take office on January 1 following their election for terms of two years and until their successors are elected and qualified. Successors to such members shall be elected at the state-wide general election in 2006. Such members shall take office on January 1 following their election for terms of four years and until their successors are elected and qualified.
(c) The members of the board of commissioners of Cook County from Commissioner Districts 2, 3, and 4 shall be elected at the state-wide general election in 2004. Such members shall take office on January 1 following their election for terms of four years and until their successors are elected and qualified.
(d) Successors to members elected under subsections (b) and (c) of this section shall be elected at the state-wide general election next preceding the expiration of such terms of office and shall take office on January 1 following their election for terms of four years and until their successors are elected and qualified."

SECTION 2.
It shall be the duty of the attorney for the governing authority of Cook County to submit this Act for approval pursuant to Section 5 of the federal Voting Rights Act of 1965, as amended.

SECTION 3.
All laws and parts of laws in conflict with this Act are repealed.
