The House Committee on
Judiciary offers the following substitute to SB 44:
A BILL TO BE
ENTITLED AN ACT
To amend Code Section 19-9-3 of the Official Code of Georgia
Annotated, relating to discretion of court in custody disputes, right of child
14 years old or older to select custodial parent, review of visitation rights,
grandparent visitation, and policy, so as to provide for limited civil liability
for a court appointed custody evaluator or court appointed guardian ad litem
under certain circumstances; to provide for related matters; to repeal
conflicting laws; and for other purposes.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF
GEORGIA:
SECTION 1.
Code Section 19-9-3 of the Official Code of Georgia
Annotated, relating to discretion of court in custody disputes, right of child
14 years old or older to select custodial parent, review of visitation rights,
grandparent visitation, and policy, is amended by striking paragraph (6) of
subsection (a) of said Code section and inserting in its place the
following: "(6)
The court is authorized to order a psychological custody evaluation of the
family or an independent medical evaluation. In addition to the privilege
afforded a witness, neither a court appointed custody evaluator nor a court
appointed guardian ad litem shall be subject to civil liability resulting from
any act or failure to act in the performance of his or her duties unless such
act or failure to act was in bad
faith."
SECTION 2.
All laws and parts of laws in conflict with this Act are
repealed.
