A BILL TO BE
ENTITLED AN ACT
To amend Code Section 40-5-71 of the Official Code of
Georgia Annotated, relating to notice of the issuance, renewal, or termination
of motor vehicle liability insurance, so as to provide for an exception
regarding with respect to certain military personnel; to provide an effective
date; to repeal conflicting laws; and for other purposes.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF
GEORGIA:
SECTION 1.
Code Section 40-5-71 of the Official Code of Georgia
Annotated, relating to notice of the issuance, renewal, or termination of motor
vehicle liability insurance, is amended by striking paragraph (2) of subsection
(a) and inserting in its place a new paragraph (2) to read as
follows: "(2)
'Terminate' or 'termination' means actual cessation of insurance coverage for
any reason other than as specified under subparagraph (b)(1)(B) of this Code
section, including without limitation cancellation, nonrenewal, or
nonpayment of premium, and without regard to whether such cessation was preceded
by any extension or grace period allowed by the
insurer."
SECTION 2.
Said Code section is further amended by striking
subparagraph (b)(1)(B) and inserting in its place a new subparagraph (b)(1)(B)
to read as
follows: "(B)(i)
Except as provided in division (ii) of this subparagraph, in
In cases in which the minimum motor vehicle insurance coverage
required by Chapter 34 of Title 33 terminates, the insurer shall by electronic
transmission notify the department of such coverage termination on or before the
date coverage ends or, if termination is at the request of the insured, then on
the date such request is processed by the insurer. Insurance coverage
termination information included in such notice shall include vehicle
identification number and the date of coverage termination. For the purposes of
this Code section, the Commissioner of Insurance shall furnish such notices to
the department upon termination of a certificate of
self-insurance. (ii) The requirements of division
(i) of this subparagraph shall not apply where the sole reason for termination
of coverage is due to the insured being a member of the armed forces of the
United States stationed in a foreign country pursuant to military orders
specifying a permanent or temporary change of station. The exception provided
by this division shall only apply during the qualifying period specified in the
military orders or during the qualifying period of subsequent military orders
issued which result in another change of station in a foreign country if a copy
of such orders has been provided to the insurer by the
insured."
SECTION 3.
This Act shall become effective upon its approval by the
Governor or upon its becoming law without such approval.
SECTION 4.
All laws and parts of laws in conflict with this Act are
repealed.
