BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Chapter 11 of Title 45 of the Official Code of Georgia Annotated, relating
to miscellaneous offenses concerning public officers and employees, so as to
prohibit certain promotions or advertisements; to prohibit certain campaign
activities; to provide for criminal penalties; to repeal conflicting laws; and
for other purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Chapter
11 of Title 45 of the Official Code of Georgia Annotated, relating to
miscellaneous offenses concerning public officers and employees, is amended by
adding a new Code section at the end thereof, to be designated Code Section
45-11-11, to read as follows:
"45-11-11.
(a)
It shall be unlawful for any public officer elected state wide or candidate for
such office to use any public employee in the production of any audio or visual
broadcast or printed publication serving as a public service or awareness
announcement or which seeks to warn or educate the public when such broadcast or
publication has been produced in whole or in part with any public
funds.
(b)
It shall be unlawful for any public officer elected state wide or candidate for
such office to appear in any audio or video broadcast or printed publication
serving as a public service or awareness announcement or which seeks to warn or
educate the public when such broadcast or publication has been produced in whole
or in part with any public funds.
(c)
It shall be unlawful for any public officer or employee to appear in any
campaign advertisement in such
officeŕs
or
employeés
public uniform or to use the emblems, nomenclature, symbols, or equipment of the
office of such public officer or employee in such campaign
advertisement.
(d)
Any person who violates any provision of this Code section shall be guilty of a
misdemeanor and, upon conviction thereof, shall be punished by a fine of not
more than
$1,000.00."
SECTION
2.
All
laws and parts of laws in conflict with this Act are repealed.
