A BILL TO BE ENTITLED
AN ACT

To amend Article 4A of Chapter 2 of Title 20 of the Official Code of Georgia Annotated, relating to community involvement in education, so as to provide for development of a wellness plan for each school by the school council; to provide for reporting; to amend Part 3 of Article 16 of Chapter 2 of Title 20 of the Official Code of Georgia Annotated, relating to health of students, so as to require implementation of a wellness plan for each school; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Article 4A of Chapter 2 of Title 20 of the Official Code of Georgia Annotated, relating to community involvement in education, is amended by inserting a new Code section to be designated Code Section 20-2-87 to read as follows:
20-2-87.
(a) Each school council shall have the responsibility to develop a wellness plan, as part of its annual school improvement plan. The school improvement plan and wellness plan shall be submitted for adoption by the local board of education or the principal of the school, as provided in Code Section 20-2-775. The local school system shall incorporate wellness plans for individual schools into the school systeḿs wellness policy required by federal law. In developing its wellness plan, each school council shall seek suggestions from students at the school. A wellness plan shall be designed to promote good health for students in the school environment and may include without limitation: goals for nutrition education, physical activity, and other school-based activities; nutrition guidelines for foods sold on the school campus during the school day in order to promote health and reduce obesity; indoor air quality; health hazards on playgrounds; and standards for safe, clean, and hygienic school restrooms.
(b) On or before November 30 of each year, each school council shall report to the local board of education and the members of the General Assembly that represent the geographic area served by the school regarding the wellness plan, progress toward goals included in the wellness plan, school activities undertaken to advance wellness goals, and other issues relating to the schooĺs promotion of good health for students.

SECTION 2.
Part 3 of Article 16 of Chapter 2 of Title 20 of the Official Code of Georgia Annotated, relating to health of students, is amended by inserting a new Code section to be designated Code Section 20-2-775 to read as follows:
20-2-775.
Each school shall implement a wellness plan to promote good health for students in the school environment. The local board of education may delegate responsibility for adoption of a schooĺs wellness plan to the school principal. The plan shall be based upon recommendations from the school council, as provided in Code Section 20-2-87, as modified by the school principal or the local board of education. Each school principal shall maintain a written copy of the wellness plan adopted for the school.

SECTION 3.
All laws and parts of laws in conflict with this Act are repealed.
