A BILL TO BE ENTITLED
AN ACT

To amend Chapter 2 of Title 40 of the Official Code of Georgia Annotated, relating to registration and licensing of motor vehicles, so as to provide for registration of private military vehicles; to provide that the commissioner of motor vehicle safety shall implement rules and regulations relating to the registration of private military vehicles; to provide for related matters; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Chapter 2 of Title 40 of the Official Code of Georgia Annotated, relating to registration and licensing of motor vehicles, is amended by adding a new Code Section 40-2-41.2 to read as follows:
"40-2-41.2.
(a) As used in this Code section, the term 'private military vehicle' means any privately owned vehicle, including a trailer, that was manufactured for use in any countrýs military forces and is maintained to represent its military design and markings accurately, regardless of the vehiclés size, weight, or year of manufacture. Such term shall not include vehicles used for commercial purposes and vehicles owned or operated by this state, by the United States, or any foreign government.
(b) The commissioner shall authorize as a registration number the private military vehicle identification number stenciled on a private military vehicle in accordance with military regulations. When possible, the private military vehicle identification number shall be derived from the hull, data, or identification plate specific to the private military vehicle. A person who owns a private military vehicle, upon application, registration of the vehicle, and payment of all required fees, shall not be required to display a license plate on the vehicle if the vehicle is registered under the private military vehicle identification number and the number is displayed on the vehicle.
(c) The private military vehicle identification number shall be painted or stenciled a plate or the bumper or body of the private military vehicle in accordance with all pertinent military regulations relating to the vehicle.
(d) The commissioner shall provide for rules and regulations relating to the registration of private military vehicles by their private military vehicle numbers.
(e) The owner or operator of a private military vehicle shall retain the registration receipt in the private military vehicle as proof of the registration of the vehicle.
(f) Private military vehicle identification numbers registered under this Code section shall be unique and may not be transferred to another private military vehicle. In the event of a conflict between duplicate numbers on two vehicles, the first registered vehicle shall take priority and the second vehicle shall be required to display a license plate.
(g) A private military vehicle registered pursuant to this Code section may be operated on the highways of this state in the same manner and under the same conditions as any vehicle displaying a license plate of this state. An owner or operator of a private military vehicle shall be required to obtain all necessary special permits relating to oversize or overweight vehicles but not be required to obtain any other special permits for operation on the highways of this state."

SECTION 2.
All laws and parts of laws in conflict with this Act are repealed.
