Senator Adelman of the 42nd offered the following amendment to the Senate Science and Technology Committee substitute to SB 62 (LC 29 1687S):

By inserting after "admissibility into evidence;" on line 11 of page 1 the following:
"to provide for interjurisdictional cooperation in certain investigations; to provide for civil and criminal immunity for certain businesses under certain circumstances;".

By striking the quotation marks at the end of line 20 and inserting between lines 20 and 21 of page 12 the following:

"16-9-110.
Any law enforcement unit or prosecutorial office of the State of Georgia is hereby authorized to apply to the court or other appropriate entity of the United States or any other state with jurisdiction over a respondent for the issuance of search warrants, subpoenas, or orders to produce as may be appropriate to further a pending criminal investigation or prosecution of a pending criminal trial of a crime enumerated in Code Section 16-9-108.

16-9-111.
Any business located within the State of Georgia that provides electronic communication services or remote computing services, when served with a search warrant, subpoena, notice to produce, notice of deposition, or order to disclose properly issued by another state to produce records related to investigation or trial of a criminal offense that would reveal the identity of the customers using those services, data stored by, or on behalf of, the customer, the customeŕs usage of those services, the recipient or destination of communications sent to or from those customers, or the content of those communications shall produce those requested records as if that search warrant, subpoena, notice, or order had been issued by a Georgia court, provided that such business has the right to object that such compliance is unduly burdensome or oppressive.

16-9-112.
No civil or criminal cause of action shall lie against any foreign or Georgia business or its officers, employees, agents, or other persons for providing records, information, facilities, or assistance pursuant to Code Section 16-9-109 or 16-9-111.'"
