BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend an Act creating a new charter for the City of Auburn, approved February
17, 1949 (Ga. L. 1949, p. 807), as amended, particularly by an Act approved
April 19, 1989 (Ga. L. 1989, p. 5011), so as to provide that certain areas shall
not be included as part of the City of Auburn; to provide for submission; to
repeal conflicting laws; and for other purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
An
Act creating a new charter for the City of Auburn, approved February 17, 1949
(Ga. L. 1949, p. 807), as amended, particularly by an Act approved April 19,
1989 (Ga. L. 1989, p. 5011), is amended by adding at the end of Section 1.11 the
following:
"(c)(1)
The following described parcels of land, as identified by the taxpayers,
addresses, and tax ID numbers therefor as such were on file and of record in the
office of the tax commissioner of Barrow County as of February 15, 2007, shall
not be included as part of the City of Auburn, any change in taxpayers after
such date notwithstanding:

In addition to those parcels of land described in paragraph (1) of this
subsection, the following rights of way, as such existed on February 15, 2007,
shall not be included as part of the City of Auburn:
(A)
All of Autry Road west and south of its intersection with Lyle
Road;
(B)
Kilcrease Road (Sixth Street) from its intersection with Woodlawn Drive south to
its intersection with Etheridge Drive; and
(C)
All of County Line Auburn Road north and east of its intersection with Parks
Mill Road."
SECTION
2.
The
governing authority of Barrow County shall through its legal counsel cause this
Act to be submitted for preclearance under the federal Voting Rights Act of
1965, as amended; and such submission shall be made to the United States
Department of Justice or filed with the appropriate court no later than 30 days
after the date on which this Act is approved by the Governor or otherwise
becomes law without such approval.
SECTION
3.
All
laws and parts of laws in conflict with this Act are repealed.
