A
RESOLUTION
Authorizing
and empowering the State Properties Commission, for and on behalf of and in the
name of the State of Georgia, to convey certain state owned real property
located in Augusta, Georgia, to the Augusta, Georgia, commission; to repeal
conflicting laws; and for other purposes.
WHEREAS,
the East Central Georgia Regional Library in Augusta, Georgia, has used, is
using, and desires to continue to use for purposes of a library for the blind
and for audio-visual purposes certain real property located at 425 Ninth Street
(James Brown Boulevard) in Augusta, Georgia, and presently owned by the State of
Georgia, to be fully described by the Augusta, Georgia, commission as provided
in this resolution; and
WHEREAS,
the property is now under the custody and management of the Department of
Technical and Adult Education; and
WHEREAS,
subsection (a) of Code Section 20-5-48 of the Official Code of Georgia Annotated
provides in pertinent part that "A clear title in fee simple to an approved site
on which a library facility is to be located shall be held by either the library
board of trustees or the county or municipality"; and
WHEREAS,
pursuant to said subsection (a) of Code Section 20-5-48, it is appropriate that
the state convey title to the property to the Augusta, Georgia, commission;
and
WHEREAS,
the power to deal with and to dispose of state owned property is vested in the
General Assembly of Georgia.
NOW,
THEREFORE, BE IT RESOLVED AND ENACTED BY THE GENERAL ASSEMBLY OF
GEORGIA:
SECTION
1.
That
the State of Georgia is the owner of certain real property located at 425 Ninth
Street (James Brown Boulevard), in Augusta, Georgia, hereinafter referred to as
the "property," and that in all matters relating to the property the State of
Georgia is acting by and through the State Properties Commission.
SECTION
2.
That
the State of Georgia, acting by and through the State Properties Commission,
convey the property to the Augusta, Georgia, commission.
SECTION
3.
That
said conveyance be subject to the following:
(1)
The consideration for the conveyance of said property shall be for a sum not
less than the fair market value of the property;
(2)
That the Augusta, Georgia, commission prepare and submit to the State Properties
Commission for approval a plat of survey and legal description of the property
prior to the conveyance; and
(3)
Such other terms and conditions as determined by the State Properties Commission
to be in the best interests of the State of Georgia.
SECTION
4.
That
the State Properties Commission is authorized and empowered to do all acts and
things necessary and proper to effect such conveyance.
SECTION
5.
That
this resolution shall become effective as law upon its approval by the Governor
or upon its becoming law without such approval.
SECTION
6.
That
all laws and parts of laws in conflict with this resolution Act are repealed.
