A BILL TO BE ENTITLED
AN ACT


To amend Code Section 31-6-2 of the Official Code of Georgia Annotated, relating to definitions relative to state health planning and development, so as to revise the definition of "new institutional health service"; to provide for related matters; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Code Section 31-6-2 of the Official Code of Georgia Annotated, relating to definitions relative to state health planning and development, is amended by revising division (14)(G)(iii) as follows:
"(iii) Surgery in an operating room environment, including but not limited to ambulatory surgery; provided, however, this provision shall not apply to surgery performed in the offices of an individual private physician or single group practice of private physicians if such surgery is performed in a facility that is owned, operated, and utilized by such physicians who also are of a single specialty and the capital expenditure associated with the construction, development, or other establishment of the clinical health service does not exceed the amount of $1 million and provided, further, that for purposes of this division, general surgery shall be treated in all respects in the same manner as a single specialty, including applicable rules and regulations of the department as they relate to this division and to single specialties; and"

SECTION 2.
All laws and parts of laws in conflict with this Act are repealed.
