BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Chapter 12 of Title 16 of the Official Code of Georgia Annotated, relating
to offenses against health and morals, so as to provide a minimum age to
purchase certain medicines; to provide for methods to communicate the minimum
age requirement; to repeal conflicting laws; and for other
purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Chapter
12 of Title 16 of the Official Code of Georgia Annotated, relating to offenses
against health and morals, is amended by adding a new Article 8 to read as
follows:
"ARTICLE
8
16-12-180.
(a)
For purposes of this Code section, 'cough medicine' means any medicine sold over
the counter containing as an active ingredient dextromethorphan
(DXM).
(b)
No person shall sell or transfer possession of any cough medicine to another
person under 18 years of age. All places of business selling cough medicine
shall clearly mark all cough medicine products to indicate that a person must be
18 years of age or older to purchase such products.
(c)
Any person violating this Code section shall be guilty of a
misdemeanor."
SECTION
2.
All
laws and parts of laws in conflict with this Act are repealed.
