BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Code Section 35-8-6 of the Official Code of Georgia Annotated, relating to
the appointment of the executive director of the Georgia Peace Officer Standards
and Training Council, so as to provide for salary increases for certified
investigators employed with the council consistent with other state employed
certified investigators; to provide for related matters; to provide an effective
date; to repeal conflicting laws; and for other purposes.

IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Code
Section 35-8-6 of the Official Code of Georgia Annotated, relating to the
appointment of the executive director of the Georgia Peace Officer Standards and
Training Council, is amended by revising subsection (c) as follows:
"(c)
The executive director is authorized to appoint certain investigators for the
purpose of carrying out the provisions of this chapter. The executive director
and persons so appointed shall meet all employment and training requirements of
this chapter as for all other peace officers and shall have all of the powers of
other peace officers.
Any
appropriation authorizing a salary increase for any state employed certified
investigators which exceeds salary increases authorized for state employees
generally shall also apply to certified investigators employed by the
council. Any investigator of the council
shall have access to and may examine any writing, document, or other material
which is deemed by the chairman of the council to be related to the fitness of
any peace officer or applicant to practice as a peace officer. The chairman or
executive director of the council may issue subpoenas to compel such access.
When a subpoena is disobeyed, the council may apply to the superior court of the
county where the person to whom the subpoena is issued resides for an order
requiring obedience. Failure to comply with such order shall be punishable as
for contempt of court."
SECTION
2.
This
Act shall become effective upon its approval by the Governor or upon its
becoming law without such approval.
SECTION
3.
All
laws and parts of laws in conflict with this Act are repealed.
