A
RESOLUTION
Authorizing
the conveyance of certain state owned real property located in City of
Thomaston, Upson County, Georgia; to repeal conflicting laws; and for other
purposes.
WHEREAS:
(1)
The Georgia Department of Transportation, an agency of the State of Georgia, is
the owner of a certain parcel of real property located in the City of Thomaston,
Upson County, Georgia;
(2)
Said real property is all that tract or parcel of land containing 4.03 acres,
more or less, together with all improvements thereon, in the Southwest part of
the City of Thomaston, Upson County, Georgia, bounded as follows: North by
lands formerly owned by R. E. Hightower, Sr.; East by lands formerly owned by M.
C. & P. N. Johnston; and South and West by lands formerly owned by the
Citizens & Southern Bank of Thomaston, Georgia. This is the same tract
conveyed to said City of Thomaston by deed of J. W. McDaniel recorded in Deed
Book 41, page 32 in the Clerk´s Office, Upson Superior Court; but a plat
showing an accurate survey of said tract as here conveyed is recorded in Plat
Record One at page 33 in said Clerk´s Office, and is by reference herein
made a part of the description of said tract;

Bearing of S 40°51ʹ25" E and a Distance of 225.68' to the point
of beginning; thence a Bearing of N 49°07ʹ35" E and Distance of
80.49'; thence a Bearing of N 43°15ʹ32" E and Distance of 22.26';
thence a Bearing of S 40°07ʹ27" E and Distance of 107.72'; thence
a Bearing of S 13°34ʹ07" W and Distance of 224.36'; thence a

Said property is under the custody and control and was used by the Georgia
Department of Transportation as a District Office building;
(4)
The above-described property was conveyed to the State Highway Board of Georgia
in May, 1932, from the City of Thomaston, Georgia, for a consideration of $5.00
and other good and valuable consideration; and
(5)
Upson County is desirous of acquiring the above-described property for public
purpose.
NOW,
THEREFORE, BE IT RESOLVED AND ENACTED BY THE GENERAL ASSEMBLY OF
GEORGIA:
SECTION
1.
That
the Department of Transportation, an agency of the State of Georgia, is the
owner of the above-described City of Thomaston, Upson County, Georgia real
property.
SECTION
2.
That
the above-described real property may be conveyed by appropriate instrument to
Upson County for a consideration of $1.00, so long as the property is used for
public purpose, and such further consideration and provision as the Department
of Transportation shall in its discretion determine to be in the best interests
of the State of Georgia.
SECTION
3.
That
the Department of Transportation is authorized and empowered to do all acts and
things necessary and proper to effect such conveyance.
SECTION
4.
That
the deed of conveyance shall be recorded by the grantee in the Superior Court of
Upson County, Georgia and a recorded copy shall be forwarded to the Department
of Transportation.
SECTION
5.
That
custody of the above-described property shall remain in the Department of
Transportation until the property is conveyed.
SECTION
6.
That
this resolution shall become effective upon its approval by the Governor or upon
its becoming law without such approval.
SECTION
7.
That
all laws and parts of laws in conflict with this resolution are repealed.
