BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Code Section 40-6-397 of the Official Code of Georgia Annotated, relating
to aggressive driving, so as to define the offense of aggressive driving; to
provide an effective date; to repeal conflicting laws; and for other
purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Code
Section 40-6-397 of the Official Code of Georgia Annotated, relating to
aggressive driving, is amended by revising subsection (a) as
follows:
"(a)
A person commits the offense of aggressive driving when he or she operates any
motor vehicle with the intent to annoy, harass, molest, intimidate, injure, or
obstruct another person, including without limitation violating Code Section
40-6-42, 40-6-48, 40-6-49, 40-6-123, 40-6-184, 40-6-312, or 40-6-390 with such
intent. A
person commits the offense of aggressive driving when he or she intentionally
fails to provide a four-foot safety margin when passing bicyclists or
pedestrians."
SECTION
2.
All
laws and parts of laws in conflict with this Act are repealed.
