RESOLUTION
Proposing
an amendment to the Constitution so as to provide that the paramount right to
life is vested in each human being from the moment of fertilization without
regard to age, race, sex, health, function, or condition of dependency; to
provide that certain powers are not limited by this amendment; to provide for
submission of this amendment for ratification or rejection; and for other
purposes.
BE
IT RESOLVED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Article
I, Section I of the Constitution is amended by redesignating Paragraph XXIX as
Paragraph XXX and inserting a new Paragraph XXIX to read as
follows:
"Paragraph
XXIX.
Paramount
right to life.
(a) The rights of every person shall be recognized, among which in the first
place is the right of every innocent human being to life. The right to life is
the paramount and most fundamental right of a person.
(b)
With respect to the fundamental and inalienable rights of all persons guaranteed
in this Constitution, the word 'person' applies to all human beings,
irrespective of age, race, sex, health, function, or condition of dependency,
including unborn children at every state of their biological development,
including fertilization.
(c)
Nothing in this Paragraph shall be construed to limit the right of the State of
Georgia to use capital punishment to enforce the laws of this
state.
(d)
Nothing in this Paragraph shall be construed to limit the right of the State of
Georgia to allow and regulate the use of advance directives or living
wills.
(e)
Nothing in this Paragraph shall be construed to limit the right of the State of
Georgia to allow and regulate the use of
contraceptives."
SECTION
2.
The
above proposed amendment to the Constitution shall be published and submitted as
provided in Article X, Section I, Paragraph II of the Constitution. The ballot
submitting the above proposed amendment shall have written or printed thereon
the following:

( ) NO

Shall
the Constitution of Georgia be amended so as to provide that the paramount right
to life is vested in each human being from the moment of fertilization without
regard to age, race, sex, health, function, or condition of
dependency?"

All
persons desiring to vote in favor of ratifying the proposed amendment shall vote
"Yes." All persons desiring to vote against ratifying the proposed amendment
shall vote "No." If such amendment shall be ratified as provided in said
Paragraph of the Constitution, it shall become a part of the Constitution of
this state.
