A BILL TO BE ENTITLED
AN ACT


To amend Article 1 of Chapter 10 of Title 45 of the Official Code of Georgia Annotated, relating to codes of ethics, so as to provide for a time limitation for signing an affidavit to validate an address of an elected public official; to provide for related matters; to provide an effective date; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Article 1 of Chapter 10 of Title 45 of the Official Code of Georgia Annotated, relating to codes of ethics, is amended by adding a new Code section to read as follows:
"45-10-6.
(a) An elected public official who has been lawfully required to sign an affidavit to validate his or her legal address within the district that he or she has been elected to serve shall sign and file such affidavit with the appropriate requesting entity within two business days of being personally served with notice of such requirement. Any elected public official who fails to properly sign and file such affidavit shall have violated the code of ethics for government service.
(b) The time period for filing the affidavit required by this Code section shall be extended for an additional ten business days where the elected official is unable to file due to an illness of the official or his or her immediate family member requiring medical attention or the death of an immediate family member.
(c) The time period for filing the affidavit required by this Code section shall be extended for a reasonable period of time where the elected official is unable to file due to a declared state of emergency or an act of God."

SECTION 2.
This Act shall become effective on July 1, 2009.

SECTION 3.
All laws and parts of laws in conflict with this Act are repealed.
