House Committee on Natural Resources and Environment offers the following
substitute to HB 262:

BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Code Section 44-5-60 of the Official Code of Georgia Annotated, relating
to covenants running with the land, so as to prohibit enforcement of certain
covenants which would require use of certain plants during watering
restrictions; to provide for related matters; to provide an effective date; to
repeal conflicting laws; and for other purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Code
Section 44-5-60 of the Official Code of Georgia Annotated, relating to covenants
running with the land, is revised by adding a new paragraph (5) to subsection
(d) to read as follows:
"(5)
Notwithstanding any other provision of this Code section, a covenant that
requires the use of specified grasses, shrubs, trees, or bushes shall not be
enforced in this state so as to require a property owner to violate any state or
state authorized local outdoor water use
restrictions."
SECTION
2.
This
Act shall become effective upon its approval by the Governor or upon its
becoming law without such approval.
SECTION
3.
All
laws and parts of laws in conflict with this Act are repealed.
