The House Committee on Science & Technology offers the following substitute to HB 460:

A BILL TO BE ENTITLED
AN ACT

To amend Chapter 2 of Title 8 of the Official Code of Georgia Annotated, relating to standards and requirements for construction, alteration, etc., of buildings and other structures, so as to define a term; to provide that before agreeing to participate in the federal Section 8 Housing Choice Voucher Program, a landlord, property manager, or property owner shall give certain notice; to provide for related matters; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Chapter 2 of Title 8 of the Official Code of Georgia Annotated, relating to standards and requirements for construction, alteration, etc., of buildings and other structures, is amended by adding a new article to read as follows:

"ARTICLE 4

8-2-230.
As used in this article, the term 'Section 8 Housing Choice Voucher Program' means that program administered by the federal Department of Housing and Urban Development to provide rent vouchers to persons with very low incomes.

8-2-231.
Any landlord, property manager, or property owner contemplating qualifying for participation in the Section 8 Housing Choice Voucher Program shall file a public notice as provided in Code Section 8-2-232.

8-2-232.
The public notice provided for in Code Section 8-2-231 shall run in the legal organ of the county in which the property is located and shall also be submitted, if applicable, to any homeowners' association at its address of record by registered or certified mail or statutory overnight delivery at least once not later than two weeks but not earlier than one month prior to the date of such qualification. The homeowners' association may disseminate the notice or the contents of the notice to its members via its preferred means of communication, which may include, without limitation, a newsletter or website. Such notice shall specify the street address of the property affected, the number of Section 8 Housing Choice Voucher Program housing units which will be created, and the street address and telephone number of the landlord, property manager, or property owner."

SECTION 2.
All laws and parts of laws in conflict with this Act are repealed.
