A BILL TO BE ENTITLED
AN ACT


To amend Article 2 of Chapter 6 of Title 50 of the Official Code of Georgia Annotated, relating to the state auditor, so as to provide for effects of certain state or local government entities' failures to perform audits required by law; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Article 2 of Chapter 6 of Title 50 of the Official Code of Georgia Annotated, relating to the state auditor, is amended by adding a new Code section to read as follows:
"50-6-33.
If the state auditor finds that a state department, agency, board, bureau, commission, or authority; political subdivision of the state; or local government authority has not caused an audit to be timely performed as otherwise required by law, then the state auditor shall give written notice of such noncompliance to the government entity. If such government entity fails to comply with such audit requirement for more than 12 months after receipt of such notice, then the state auditor shall provide notice of such failure to the Office of Planning and Budget or, in the case of a noncomplying political subdivision or local government authority, to the Department of Community Affairs, and such noncomplying government entity shall not be eligible for any further draws upon the state treasury or grant of state funds until the required audit has been completed. Failure by a state or local government official having the direct authority and responsibility to cause such required audit to be performed within 24 months after receipt of such notice shall be deemed to be ceasing to perform the duties of office for purposes of Code Section 45-5-1."

SECTION 2.
All laws and parts of laws in conflict with this Act are repealed.
